You delicately adjust the parameters, and the virtual characters on your phone morph into any likeness you desire. In that moment, you feel like a creator, wielding the power of technology to shape reality. You even try simulating the appearance of a famous movie star, experiencing an unprecedented and exhilarating sensation that not only showcases the power of technology but also the joy of creativity. However, unbeknownst to you, in some corner of this vast digital realm, someone else is using the same technology to craft a virtual likeness identical to yours. They meticulously fine-tune every detail until this virtual persona is nearly indistinguishable from you. Then, they employ this likeness to engage in video chats with your family members. Everything unfolds so naturally that your loved ones fail to detect anything amiss. They joyfully converse with you on the screen, completely unsuspecting. However, they are unaware that this familiar face is nothing but a carefully crafted virtual persona… This isn’t a scenario from a science fiction novel. In fact, the fantasies and concerns about technology from two decades ago have gradually materialized, urging us to contemplate the dual nature of this technology: while it brings joy and creativity to people, it may also be maliciously exploited, leading to unforeseen consequences.
With the increasing prevalence of deepfake technology, this story prompts us to ponder: How can we ensure the healthy development of artificial intelligence technology as it advances rapidly? How can we prevent its misuse? In other words, while respecting the inevitable historical development, how do we explore the controllability of artificial intelligence technology on the social ethical order in the context of the new era?
Overview
Deepfake, a technology based on deep learning algorithms, particularly Generative Adversarial Networks (GANs) and speech synthesis, can produce highly realistic audiovisual content, enabling lifelike imitations of personas and precise replication of voices. From simple facial replacements to complex scene compositions, the development of deepfake technology has progressed by leaps and bounds.
However, as deepfake technology matures, it brings not only technological breakthroughs but also ethical challenges. As Ian Goodfellow stated in “Deep Learning,” deepfake technology itself is neutral, akin to a double-edged sword, with machine learning being a tool that can be used for good or evil.
When technology can easily alter people’s sensory perceptions and blur the lines between reality and fiction, how do we define “truth”? When malicious actors utilize this technology to fabricate false information, defame others, or manipulate public opinion, how do we maintain social order and protect individual rights? Deepfake technology is no longer just an innovation at the technological level; it is a profound challenge to social ethics.
Challenges of Legal and Ethical Boundaries
Privacy Violation
The emergence of Deepfake technology blurs the boundaries of personal privacy. Malicious users can easily fabricate the words and actions of others using Deepfake technology, create false information, and implant others’ faces and voices into inappropriate content such as pornography and violence, thereby infringing on others’ image rights and privacy. Once these false information spreads, it may lead to defamation, slander, and severe damage to the reputation and image of the victims. This behavior not only causes mental anguish to the victims but may also subject them to social discrimination and exclusion. Moreover, due to the high fidelity of Deepfake technology, cybercriminals can use Deepfake technology to produce seemingly authentic videos or audios, deceiving people into believing false information. For example, they may create a fake political speech video or forge a celebrity endorsement advertisement. These videos look so authentic that ordinary people find it difficult to discern their authenticity. Therefore, they may be misled and disclose personal privacy information or even suffer financial losses unknowingly.
International pop star Taylor Swift has recently found herself at the center of a controversy involving the rampant spread of maliciously created videos online. Without her consent, Swift’s face was maliciously overlaid onto indecent scenes using Deepfake technology. This high-profile case has drawn attention to the significant social harm brought about by the rapid advancement of technology, thoroughly exposing the immense social risks posed by the technological advancement outpacing ethical and legal regulations. And this multimillionaire star won’t be the first, nor the last, victim of Deepfake technology.
Victims of Deepfake technology are not limited to Taylor Swift. In fact, this millionaire celebrity is just one of the many victims of this increasingly prevalent form of digital manipulation. Celebrities, politicians, and even ordinary people have found themselves targeted by malicious actors who use Deepfake software to create videos intended to embarrass, damage reputation, or spread misinformation.
Misinformation and Deception:
In the era of social media, information spreads rapidly, and the dissemination of false content can have serious implications for public perception. This not only undermines social trust but also leads to panic, misunderstanding, and bias. Herbert Schiller discussed the issue of information dissemination and manipulation in his article “Mass Communications and American Empire.” He first pointed out the significant role that mass media plays in shaping public consciousness and guiding social opinion. However, this role is not entirely neutral and objective. Instead, it is often influenced by multiple factors such as politics, economics, and culture. In the case of the United States, mass media is often used to promote American values and lifestyle, shaping an idealized image of America. This image is widely accepted domestically and has far-reaching effects internationally.
Furthermore, false news and information manipulation in American elections were employed by some malicious entities using AI technology to generate false political advertisements, videos, and social media posts, attempting to influence public opinion and voting intentions. False information is intentionally designed to be highly realistic, making it difficult for people to distinguish between truth and falsehood, thereby exerting significant misleading effects. In addition to directly misleading the public, false news and information manipulation may have far-reaching consequences for election results. Some studies suggest that false information may influence voters’ decision-making, thereby altering election outcomes. Moreover, false news and information manipulation may undermine the fairness and transparency of elections, weakening people’s trust and support for the electoral system.
Challenges of Technological Regulation and Legal Governance
Gordon Moore, one of the co-founders of Intel, predicted in 1965 that computer capabilities would grow exponentially. Today, a citizen of Africa holding a smartphone has access to more information in a few seconds than all the information available to the entire US government (including the FBI, the Pentagon, etc.) forty years ago. In terms of protecting personal privacy, existing laws may not effectively address the new types of infringements brought about by Deepfake technology. Although the misuse of Deepfake technology also involves illegal acts such as defamation and false accusation, there is still no consensus on how to define and punish these acts in the legal community. Ethically, the abuse of Deepfake technology challenges social ethics and moral concepts. Malicious users may use this technology to fabricate the words and actions of others, damaging their reputation and dignity. This behavior not only violates social morality but also seriously infringes on the legitimate rights and interests of others.
